Opposition parties in Madhesh Province are preparing to approach the Supreme Court challenging the appointment of Chief Minister Saroj Kumar Yadav.
Despite the option under Article 168(2) of the Constitution, Province Chief Sumitra Subedi Bhandari appointed Yadav this morning under Article 168(3). Opposition leaders claim this move was unconstitutional.
Manish Suman, a leader of JSP Nepal, confirmed that the party is planning to file a case in the Supreme Court today against the appointment. Opposition parties argue that, given the provision under sub-article (2), the Chief Minister should have been appointed accordingly, making the use of sub-article (3) inappropriate.
The opposition includes parties such as LSP, JSP Nepal, CPN–Maoist Centre, and CPN–Unified Socialist. The Nepali Congress has also expressed its opposition to the appointment.
Province Chief Bhandari, who left Janakpur for Kathmandu citing health treatment, administered the oath of office and secrecy to UML Parliamentary Party leader Yadav at a hotel in Bardibas at 4:30 AM this morning.
