Kathmandu — Police have sought a written opinion from the government attorney regarding the case involving former Prime Minister K.P. Sharma Oli and former Home Minister Ramesh Lekhak. The request letter has already been registered at the government attorney’s office, according to sources.
The move follows a recent order by the Supreme Court of Nepal directing authorities not to extend their detention further. Oli, who is also chairman of the Communist Party of Nepal (UML), and Nepali Congress leader Lekhak were arrested for investigation in a homicide-related case based on recommendations from the Janajati (JENJI) movement probe report.
The investigation officer, DSP Raju Adhikari of the District Police Range, Bhadra Kali, formally requested legal guidance from the District Government Attorney’s Office.
Based on the attorney’s opinion, authorities will decide whether to release the two leaders on general date (hajiri jamani) or proceed with filing a case in court.
Although the law allows police up to 25 days to investigate a homicide case, the Supreme Court has instructed that within the current extended five-day deadline, authorities must either file the case or release them on bail as per Section 15 of the National Criminal Procedure Code, 2017.
Police had already received a total of 12 days across three extensions for investigation. The final five-day extension, granted by the district court on Chaitra 22, is set to expire
