The Judicial Council of Nepal has recommended the names of six justices for the appointment of the next Chief Justice of the Supreme Court of Nepal to the Constitutional Council of Nepal.
The process for appointing a new Chief Justice has moved forward as the current Chief Justice Prakash Man Singh Raut is set to retire on Chaitra 18 upon reaching the constitutional age limit of 65.
Those recommended for the position include the senior-most Supreme Court justice Sapana Pradhan Malla, along with justices Dr. Manoj Kumar Sharma, Kumar Regmi, Hari Phuyal, Til Prasad Shrestha and Dr. Nahakul Subedi.
According to legal provisions, a person must have served as a Supreme Court justice for at least three years to qualify for the position of Chief Justice.
As required by the constitution, the recommendation for a new Chief Justice must be made at least one month before the incumbent retires. Following this provision, the Judicial Council has forwarded the records of eligible justices to the Constitutional Council.
The Constitutional Council, chaired by the Prime Minister, will now recommend one candidate from the six nominees. After the recommendation is approved by the Parliamentary Hearing Committee of Nepal, the individual will be formally appointed as Chief Justice by the Office of the President of Nepal.
