
The Supreme Court has ordered Prime Minister KP Sharma Oli to submit reasons for not seeking a vote of confidence after losing the support of the Janata Samajwadi Party (JSP).
The order was issued by a single bench of Justice Sunil Kumar Pokharel in response to a writ petition filed by advocate Birendra KC, who argued that the prime minister violated constitutional provisions by failing to seek a trust vote.
The JSP formally withdrew its support on Asar 32, 2082 (mid-July 2025), but PM Oli has not yet sought a vote of confidence.
According to Article 100 and Article 11(2) of the Constitution, if the support of a coalition partner is withdrawn, the Prime Minister must seek a vote of confidence within 30 days. Failure to do so, or inability to secure majority support, results in automatic removal from office.
The writ petition names the Prime Minister, Council of Ministers, Speaker, Federal Parliament Secretariat, and the Office of the President as respondents.
