The Supreme Court’s Constitutional Bench is set to hear today (Wednesday) a writ petition filed against the appointment of former Chief Justice Sushila Karki as Prime Minister, arguing that the appointment is unconstitutional.
The case has been scheduled before a bench comprising Chief Justice Prakashman Singh Raut and Justices Sapana Pradhan Malla, Hari Prasad Phuyal, Manoj Kumar Sharma, and Saranga Subedi.
Following the Gen Z movement on Bhadra 23–24, President Ram Chandra Paudel appointed Sushila Karki as Prime Minister on Bhadra 27.
Advocate Dr. Punya Prasad Khatiwada filed the writ petition demanding that the appointment be annulled, stating that under Article 76 of the Constitution, a former Chief Justice is not eligible to become Prime Minister, and that Article 132(9) also prohibits such a qualification.
The petition accuses the President of a direct constitutional violation, asserting that he lacks the authority to remove constitutional obstacles and that the time limit under Article 305 has already expired.
Respondents in the case include President Ram Chandra Paudel, Prime Minister Sushila Karki, the Nepal Army, political parties, National Assembly Chairman Narayan Prasad Dahal, and Speaker Devraj Ghimire.
