The Supreme Court of Nepal on Tuesday issued an order directing that Durga Prasai not be kept in detention. The joint bench of Justices Manoj Kumar Sharma and Meghraj Pokhrel issued a writ of habeas corpus in favor of Prasai.
Prasai had been taken into custody after the Election Commission of Nepal, on 4th Falgun 2082 BS, sent a letter requesting police to detain him for investigation. The detention was authorized by the District Administration Office.
Challenging his detention as arbitrary, Prasai had filed a habeas corpus petition with the Supreme Court, which granted his request. Earlier, on Monday, the Court had ordered the retrieval of the complete file regarding the Election Commission’s decision to detain Prasai. The joint bench of Justices Nahakul Subedi and Meghraj Pokhrel instructed that the file be obtained to verify that Prasai’s arrest followed the Commission’s directives.
