The Supreme Court has issued an interim order to ensure proportional representation of persons with disabilities in the electoral process.
A joint bench of Justices Hari Prasad Phuyal and Tek Prasad Dhungana issued the interim order in the name of the Election Commission, directing it to ensure proportional representation of persons with disabilities.
The order follows a writ petition filed by Madhav Prasad Chamlagain, who argued that despite provisions for representation of various sectors and communities, persons with disabilities have been excluded from proportional representation.
In the petition, it was claimed that the Government of Nepal, through an ordinance, amended Schedule–1 of the House of Representatives Election Act, 2017, and while redefining the closed-list (cluster) system under the proportional representation electoral system, failed to clearly, mandatorily, and explicitly ensure representation of persons with disabilities.
