
Rastriya Swatantra Party (RSP) Chairperson Rabi Lamichhane has filed a petition at the Rupandehi District Court, requesting his release on a bank guarantee equivalent to the compensation amount he is liable to pay. Lamichhane submitted the application on Saun 19 (August 3), asking to be freed under the provision of posting a bank guarantee.
Lamichhane is currently in judicial custody at Bhairahawa Prison under the order of the High Court. Previously, the Rupandehi District Court had granted him release on bail of Rs 10 million, but the High Court overturned that decision, ordering him to be held in custody for trial. The case, which is ongoing, will now be decided by the Rupandehi District Court.
In his petition, Lamichhane has cited Sections 68 and 71 of the Criminal Procedure Code, 2074. Section 68 allows the court to keep an accused on date (tarikh) by taking bail, surety, or a bank guarantee, while Section 71 permits release on bail at any stage of the legal proceedings.
