The Supreme Court has issued an order to retrieve the case files related to the murder of Krishna Prasad Adhikari of Fujel, Gorkha. The order was issued by a bench of Justices Sunil Kumar Pokharel and Nripadhwaj Niraula.
The murder case has been pending in the Supreme Court for the past three years. On Baisakh 12, 2081, a bench of Justices Kumar Chudal and Til Prasad Shrestha had ordered that all defendants, including the government, be notified for a hearing. However, no hearing has taken place since then.
Krishna Prasad Adhikari was murdered in Chitwan in 2061 BS. He was allegedly abducted and killed by then–Maoist cadres during the armed conflict. Following a complaint filed by his father, Nanda Prasad Adhikari, a murder case was initiated in the district court.
Nanda Prasad and Ganga Maya Adhikari had filed a complaint accusing 12 individuals—including Sita Adhikari of Fujel, Gorkha, and Chhabilal Paudel—of involvement in their son’s murder. Based on this complaint, the Chitwan District Court acquitted all defendants in 2075 BS.
A bench of Judges Chandiraj Dhakal and Merina Shrestha at the Hetauda bench of the Patan High Court upheld the district court’s decision.
