The writ petition filed by former Executive Director of the Nepal Electricity Authority (NEA), Hitendra Dev Shakya, has been placed before a bench that cannot hear the case.
A hearing for Shakya’s writ was scheduled on Tuesday at the joint bench of Supreme Court Justices Manoj Kumar Sharma and Til Prasad Shrestha.
However, according to a legal practitioner, Justice Manoj Kumar Sharma and Shakya’s lawyer—former Attorney General and Senior Advocate Ramesh Badal—had previously worked in the same law firm, making the bench ineligible to hear the case.
Shakya had filed the writ challenging the government’s decision to remove him before his term ended. Earlier, on November 7, another bench of Justices Abdul Aziz Musalman and Nripadhwaj Niraula had refused to issue an interim order on Shakya’s petition.
